The Constitutional Supremacy Clause and Environmental Regulation

Abstract: Colorado's Resistance to the "Federal Noxious Weed Act" A 5 page overview of the issues surrounding the supremacy of federal law in areas of environmental regulation. Specifically addresses federal rights in regard to the control of noxious weeds, as addressed in the 1975 "Federal Noxious Weed Act", an Act which is resented by Colorado which has enacted its own requirements for the control of noxious weeds. Outlines the relevance of the supremacy clause of the Constitution of the United States and the concept of executive power, also authorized by the Constitution. Bibliography lists 3 sources.
