Abstract: 4 pages in length. Protecting the elderly when they are under the care of nursing homes or assisted living facilities has reached the point where legislation must now exist in order to guarantee and facilitate the existence - as well as utilization of - resident rights. Just because an older individual loses a significant amount of her independence by living in a state or federally run care facility, it does not mean she also forfeits the fundamental rights inherent to how she wants to live the rest of her life.
