Task Force Report: An Assessment of the Federal Arbitration Act

Abstract: This 15 page paper provides an analysis of the Federal Arbitration Act as it relates to international arbitration and commercial dispute resolution. This paper pretends that the author is a leading authority on international commercial dispute resolution who has been appointed to head a federal task force to study the manner in which the Federal Arbitration Act can improve the treatment of international commercial disputes. The Task force was asked to take due note of the FAA's age, coverage, developments in other jurisdictions, the emerging popularity of alternatives to arbitration (notably mediation) and the increasing use of advances in telecommunications to both engage in international commerce and process disputes arising therefrom. This report is a specific, detailed argument in support of reforms to the current system under the FAA. Bibliography lists 3 sources.
